Section 58 of the County Governments Act, 2012 (as amended) sets out the composition of a County Public Service Board. A Board consists of:
- a Chairperson, nominated through a competitive process and appointed by the Governor with the approval of the County Assembly;
- other members, not fewer than three and not more than five, nominated through a competitive process and appointed by the Governor with the approval of the County Assembly; and
- a Secretary, who must be a certified public secretary of good professional standing, nominated through a competitive process and appointed by the Governor with the approval of the County Assembly.
In nominating members, the Governor is required to observe the principles of gender equity, regional and ethnic balance, and the inclusion of persons with disabilities and minorities. Members must meet the requirements of Chapter Six of the Constitution on leadership and integrity and bring relevant knowledge and experience in fields such as human resource management, public administration, law, finance and governance.
Term of office and removal
Members of the Board hold office for a single term as provided in the Act. A member may be removed only on the grounds and through the procedure set out in the Act, which include serious violation of the Constitution or any other law, gross misconduct, physical or mental incapacity, incompetence, bankruptcy, or failure to declare a conflict of interest. Removal requires a petition and the involvement of the County Assembly, safeguarding the Board's independence.
